TERMS AND CONDITIONS OF ONLINE SALES AND REPAIRS

Mac Maintenance is a website for troubleshooting Apple products accessible at the address www.mac-maintenance.fr (hereinafter referred to as “the Site”), managed by the company: JSA GLOBAL CENTER COMPANY LIMITED  with trading name Mac Maintenance Company Limited.

Mac Maintenance offers remote assistance for electronic devices (computers, smartphones, tablets of the Apple brand) to professional and individual customers worldwide (hereinafter referred to as “the Client” for France).

Mac Maintenance is in no way the official Apple support but a private, paid support center by phone.

PREAMBLE: ETHICS 

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is committed to carrying out serious repairs by applying an ethical process.
Our job is to repair our customers’ Mac computers by offering efficient and rapid solutions without having to go to the store.


1. Object
 
The purpose of these general conditions is to define the terms and conditions of assistance for the device(s) that the Customer wishes to have repaired (hereinafter “the Device”). 
 
Any placing of an order by the Customer implies unreserved and irrevocable acceptance of these general conditions, which the Customer acknowledges having read prior to placing his order.
 
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited reserves the right to modify these general conditions at any time and at its sole discretion.


2 — Determining conditions relating to the Customer and the Device
 
The Customer guarantees:
 
Be a natural person of legal age, over eighteen (18) years old, and have full legal capacity to sign this contract.

Be the owner of the Device and have acquired it in a regular manner. In particular, it guarantees that the Device is not a stolen or fraudulently acquired object.
 
In the event that the Device is still under manufacturer or seller warranty, the Customer acknowledges that it could be repaired free of charge by the latter, while the repair carried out by JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is chargeable. 

The Customer acknowledges and accepts that the intervention of JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited on his Device may result in a breach of warranty of the manufacturer and/or the seller of the Device.
 
The Client agrees to receive all information concerning the service, the invoice and more generally the execution of these general conditions by email.  
 

3 — Ordering the repair service

3.1 Ordering the breakdown service by telephone
 
In order to order a support service, the Customer must follow the following steps:
   
As a preliminary:

Before contacting JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited, the Customer undertakes to have backed up all of their personal data stored on their Device, in order to be able to recover them in the event of accidental loss or destruction.

The customer also agrees to have a device that has not suffered accidental damage before troubleshooting.

The customer also agrees to own a fixed internet connection and to have a wifi wireless network at the time of troubleshooting to which his device can connect. The customer also agrees to have his connection password in order to connect to this wifi network at the time of troubleshooting.

The customer agrees to provide a telephone number on which he can be reached immediately. The customer also agrees to be available for the time necessary for troubleshooting and/or at least for a minimum of 20 minutes.

1/ for troubleshooting: The Customer has the possibility to make an appointment on the site. Each appointment is unique and recorded, it guarantees a telephone callback. Appointments are not mandatory to obtain assistance on a device, they save the customer time. 
 
2/ for purchases of services via the site, payment is made directly online or by telephone with the technician via a 100% secure platform.
 
By clicking on “View Basket”, the Customer accesses a summary page of their order, indicating the details of the service(s) and their price.
 
To validate, the Customer must click on “payment”.
 
To definitively validate the order and be able to place an order, the Customer must accept these general conditions of service provision.
 
After final validation of the order, the Customer accesses the payment module. He must choose his payment method and proceed to payment.
 
The Customer guarantees to JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited the veracity of the information communicated when placing the order, in particular his personal contact details.
 
If an error in the entry of information by the Client should result in a delay in the service, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited cannot be held responsible under any circumstances.
  

Confirmation of the order placed on the Site
 
The Customer receives a confirmation email as an acknowledgement of receipt of the order. This email is sent to the email address provided by the Customer when communicating their personal data.
 
The Customer can track his order by contacting customer service.
 

4 — Ordering a breakdown service by telephone
 
As part of a telephone troubleshooting service,
the customer may be required to provide certain information relating to the purchase.
This information is as follows:

– First and last name
– Phone number
– Postal code
– Credit card number
– The expiration date of the credit card
– The billing address


The customer confirms by telephone that he or she has the legal right to use any credit card or other payment method in connection with a purchase and that the information provided is true, correct and complete.


To protect its customers, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited provides a fast, secure and professional way to pay for its services and complies with applicable provisions of the Card Industry Data Security Standard (PCI-DSS) during the term of these terms (“PCI Compliance”).
 
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited complies with these regulations in particular with regard to the storage, processing and transmission of payment card data.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited accepts payments from all major credit and debit cards, including Visa, Mastercard, Maestro and American Express.

The collection procedure is as follows: 

The customer’s name, address, email address and card details are entered by the collection agent.
The transaction is submitted to the customer’s bank for authorization.
Once approved, confirmation is received and the customer will receive an acknowledgement by email or SMS.

Just like payments processed through a credit card reader, the procedure is secure and compliant with regulations.



5 — Troubleshooting time

When the customer orders a session by telephone or on the site, as far as possible, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited provides the service immediately. A longer deadline may be indicated to the customer at the time of ordering.
The customer must therefore make themselves available and wait for the technician’s call within the time indicated by the collection agent
.
If the customer does not make themselves immediately available for troubleshooting, refuses or blocks telephone calls from JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited or remains unreachable after several unsuccessful call attempts by the technician, the service may be cancelled without the customer being able to request a refund.
 
 
6 — Obligation to repair
 
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is not bound by an obligation of results concerning the troubleshooting of the device or any other support problem.
However, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited undertakes to do its utmost to provide its customers with the best possible assistance and to offer additional paid services if necessary and in agreement with it:  see the price of our services

In the event that JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is unable to repair the Customer’s device, the company undertakes to direct the Customer to a hardware repair service close to the Customer’s home.
 
In the event that the customer has made a mistake in their declaration and in the troubleshooting to be carried out, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited may make adjustments and will provide the customer with a new quote. The Customer must give their consent electronically or orally to proceed with the troubleshooting of their device. If the Customer does not provide any news within 5 working days or if they refuse the quote, they will only pay the price of the original service.
 
The customer is required to provide JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited with all relevant information to enable the troubleshooting to be carried out as best as possible. If the customer has failed to provide information that prevents the service from being carried out, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited cannot be held responsible and the customer may not, under any circumstances, demand a refund.

7 — JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited Warranty
 
The manipulations proposed by JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited offer no guarantee of results.
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited shall not be held liable for any direct or indirect consequences resulting from the malfunction or non-functioning of the customer’s equipment, including any loss of data, non-compliance, incompatibility, malfunction or deterioration resulting or not from its intervention. Under no circumstances, and regardless of the service requested, shall JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited be held liable for damage to the equipment and/or total or partial loss of the customer’s computer data, for whatever reason.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited does not offer physical repair of electronic devices.

8 — Legal guarantees

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is not the manufacturer of the parts used to repair the Device, within the meaning of Law No. 98-389 of May 19, 1998 relating to liability for defective products, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited cannot be held responsible in the event of defective products. Only the manufacturer will be responsible, and the manufacturer’s guarantees alone will apply.

9 — Price of services
 
The price of the assistance service is that indicated on the day of the order on the site in euros.

9.1 Troubleshooting: Troubleshooting sessions start at 39 euros for a maximum duration of 20 minutes.
In the event of additional needs, a suitable rate will be offered to the customer in advance.
The configuration session is billed at 49 euros for a maximum duration of 30 minutes.

9.2 Data Recovery: JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited offers an additional data recovery service.

The data recovery service is billed at 169 euros per analysis and includes the recovery, if possible, of 10 GB of data. In case of additional needs, an adapted rate will be offered to the customer.

The data recovery service does not guarantee that the customer will be able to recover all of their data.

9.3 System Reinstallation and Update: JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited offers an additional system reinstallation service.

Certain technical issues require reinstallation of the Mac OS X system.
The service is billed from 99 euros and includes the reinstallation of the computer’s original license.
In some cases the reinstallation can be billed 149 euros (Need to format the disk, old Mac, loss of license linked to App Store purchases) 

If multiple updates are required or multiple computers need to be updated, a flat rate will be offered to the customer not exceeding 199 euros.

In the event that the relocation assistance service fails due to a poor internet connection or a physical problem with the client’s computer, it is not refundable under any circumstances.

9.4 USB keys containing a license are sent to your home in the event that the internet connection does not allow reinstallation and in the event that no alternative solution is possible. A delivery and management fee of 20.50 euros per key is applied in addition to the price of the reinstallation.  

9.5 Remote payment fees 
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited informs its customers that services are billed through PayPal international. +
In this context, some banks add fees to secure the transaction (insurance, processing fees).
These fees are not collected by JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited and are therefore not refundable.
We invite our customers to check the conditions of this type of payment in their banking service contracts. 

10 — Conditions of Payments JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited. via PayPal

We offer a Service to speed up the payment process and save your data with PayPal.
These Terms apply, unless you expressly request otherwise in writing, when you use all of our Services.
When you make a payment with JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited, you authorize us to save your contact information. For example, we will store certain identification data, such as your email address or mobile phone number, as well as payment data that you provide to us, such as credit card, debit card or bank account numbers (“Payment Account Details”). We may also store data such as your name, billing address and cardholder name along with your Payment Account Details. By allowing us to save your data, you will be able to make payments more quickly and easily with the same contact person — this can be particularly convenient when you are using a mobile device or do not have your Payment Account Details to hand.

If we are unable to identify you (for example, you do not have a bank card or it has expired), we may verify your payment by another means (for example, by sending you a payment link by email or SMS) so that your saved Payment Account Details can be used again.
Removing a payment method from your account (for example, cancelling your credit card with your bank) does not cancel or modify your obligation to JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited or any amounts owed to it.

10.1 Debit and Credit Cards

Please ensure that you regularly update your payment card details. We may update your stored payment card details, without any action on your part, from proprietary and third-party sources. If you do not want us to update your payment card details, you may object by express written request via our contact form.

10.2 Bank accounts with JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited.

To be able to pay with JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited, you must allow us to collect and use your banking information. For example, once you have agreed to provide your banking information, a Mac maintenance agent will be able to verify the validity of your credit card and ensure that your balance is sufficient to cover your purchase. Please see the privacy policy to learn how we use your bank account information.
 
Additionally, we may use your bank account information to simplify payments and avoid waiting time when you call.
Each time you validate the purchase of a JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited. service from an agent, you authorize us to immediately debit your bank account for the amount invoiced. You authorize us to retry debiting your bank account if your bank rejects the initial debit request for any reason. You also authorize us to collect lower amounts until you have paid the amount you owe us and which corresponds to the total amount of the service you have agreed to pay. You acknowledge that the authorization you grant in this paragraph complies with the rules and produces the same legal effects as signing a paper mandate containing the same clauses.
 
The use of your bank card as a means of payment is also subject to the conditions, benefits and protections associated with your personal bank account. If you use your bank card as a means of payment and you do not have sufficient funds to pay for a service, your bank may charge you fees that will not be due to JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited. If, for your future purchases, you wish to cancel this authorization or stop using your bank card as a means of payment registered in your account, you must make a written request to our services. JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited will proceed to erase your data, if you are not liable for any amount.
 
10.3 Refunds
When a service could not be performed and you request a refund, the purchase amount will be refunded using the payment method initially used for the transaction. No other payment method will be used as a basis for a refund. If you cancel your payment method in the meantime, you will not be eligible for any refund.

10.4 Secondary payment method
If your default or selected payment method is not available or if the transaction fails with this payment method (for example, if your bank account does not have sufficient funds), we may be required to charge one of your other registered payment methods (another bank card used). In this case, we will detect before the purchase is finalized that a secondary payment method must be used (for example, during a one-off payment or the initial purchase of a subscription). If you do not want a secondary payment method to be charged, you must request this from JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited agents.
10.5 Security
We will use reasonable efforts to protect your Payment Account Data. Unfortunately, no data storage or transmission system can be guaranteed to be 100% secure. If you have reason to believe that the security of your account has been compromised, please contact us immediately at:  [email protected]

11 — Reimbursement policy for services performed

Once the service has been accepted and paid for by the customer, this does not give rise to a refund if the service has been carried out or if the customer has spoken to the technician on the telephone.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited does not engage in canvassing; it is the Customer who contacts the service directly.
When the Customer personally requests JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited, the latter decides alone to subscribe to the service offered.
The customer then gives his approval for the payment and is given a receipt with the amount.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited must in some cases send reinstallation keys by post when reinstallation by internet is not possible. In case of return, processing and return fees are applied not exceeding 25 euros per product.



12 — Personal data
 
The Customer is informed that the personal data he/she provided to place an order is processed by JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited for administrative and commercial management purposes and to produce statistics.
This processing has been declared to the National Commission for Information Technology and Civil Liberties (CNIL).
JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited reserves the right to transfer personal data to third parties for commercial prospecting purposes, if the Client has given his consent for this purpose.
 
The Customer will have to fill out a form. Fields marked with an asterisk (*) must be completed.
 
When paying online or by telephone, the Customer must complete all fields marked with an asterisk (*) and necessary to make the payment, namely, where applicable, the name of the credit card holder, the credit card number, the expiry date and the security code (visual cryptogram).
 
The personal data collected is kept for the period necessary for its processing, depending on the purposes, and in principle for a period of two (2) years following the last contact with the Client, for commercial management and prospecting purposes, except for legal exceptions.
 
At the end of this period, this data will either be deleted or made anonymous, unless expressly agreed by the Customer, renewable for the same duration. In the absence of explicit agreement, JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited will delete the Customer’s data.
 
However, personal data collected for the purpose of executing an order may be kept, in the form of archives, for a period of ten (10) years at most, in accordance with the provisions of the Commercial Code relating to the retention period of books and documents created during commercial activities as well as the limitation periods determined by the Civil Code.
 
In accordance with the “Informatique et Libertés” Law of January 6, 1978, the Client has the right to access, rectify and delete data concerning him/her, by sending a written request to  [email protected]

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited has a team of technicians duly certified by the Apple brand and/or by internal programs and training.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited is not, however, obliged to provide a technician certified by the Apple brand as part of its private repair services.
Under no circumstances could JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited be considered as official APPLE assistance. 
The customer can contact official Apple support directly in Ireland by telephone toll-free on 0 805 540 003.


15 — Service providers
 
We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

16 — Analytics
 
We may use third-party Service Providers to monitor and analyze the use of our Service.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service.
This data is shared with other Google services.
Google may use the collected data to contextualize and personalize the ads of its own advertising network.
 
You can opt-out of having your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited never makes telephone canvassing calls.
 
18 — Force majeure
 
If the performance of a contract is prevented by an event of force majeure, the contract is, as the case may be, suspended or terminated. A case of force majeure is one that is beyond the control of the Parties, which could not reasonably have been foreseen at the time of conclusion of the Contract and whose effects cannot be avoided by appropriate measures. If the impediment is temporary, the performance of the contract is suspended, unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is terminated automatically and the Parties are released from their obligations.
 
The following are considered to be cases of force majeure, without this list being exhaustive: a natural or accidental event, the intervention or failure of public authorities, blocking or malfunctioning of the internet, strikes, in particular postal services, road transport, any malfunctioning of postal services, transport, war, the impossibility of obtaining supplies, a prolonged, unforeseeable and irresistible work stoppage of several employees, an accident or delay in manufacturing, a fire, a flood, a machine breakdown, a riot, a requisition, an authoritarian reduction in imports.

19 — Miscellaneous
 
If any provision of these general conditions is declared null or inapplicable due to a court decision or the application of a law or regulation, the remaining provisions of these general conditions will remain fully in force.
 
The non-application or delay in the application of any of the provisions of the contract by a Party shall not be interpreted or understood as a waiver by this party of the application of the provision concerned.
 
Any deviation from these general conditions implies an agreement, written and signed by both Parties.
 
20 — Dispute Resolution
 
The Customer is informed of the possibility of resorting, in the event of a dispute, to a consumer dispute mediation procedure and of resorting free of charge to a consumer mediator under the conditions defined below:
 
The name of the mediator will be communicated by JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited upon request from the Client.
The latter must follow the procedure for referral to the mediator recommended by the latter. In particular, a dispute cannot be examined by the consumer mediator when:
 
a. The Customer does not provide proof that he has previously attempted to resolve his dispute directly with JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited by means of a written complaint and has not obtained a satisfactory response within 30 days.
  
b. The dispute has previously been considered or is being considered by another mediator or by a court.

c. The consumer submitted his request to the mediator more than one year after his written complaint to JSA GLOBAL CENTER COMPANY LIMITED with trading name Mac Maintenance Company Limited.

d. The dispute does not fall within the mediator’s jurisdiction.

It is the customer’s responsibility to inform themselves of these general conditions and the refund conditions before purchasing.
